The rules for submitting your articles and images to Avenstar's Article Vine are simple, but they must be followed!
Submission Guidelines:
- The articles that you submit must be your own work - You may not submit articles written by other authors and the content must be unique. No rebranded articles allowed, you must be the sole copyright holder for each article you submit. Articles written by a ghost writer are perfectly acceptable as long as they are being used only by yourself.
- By submitting your articles to Avenstar's Article Vine, you grant us the right to publish your articles - We may publish your article anywhere on our website, blog, or syndicate through RSS. We may also change where it appears, including the category, at any time.
- No affiliate links! - The articles that you submit to Avenstar's Article Vine should not contain affiliate links. It is acceptable, however, to mention the URL's of helpful sites or your own website which redirects to the recommended affiliate product.
- Submitting your articles to Avenstar's Article Vine does not entitle you to financial compensation of any kind - You will not receive compensation from Avenstar's Article Vine.
- Submitting an article in no ways guarantees inclusion on Avenstar's Article Vine- We reserve the right to reject an article submission for any reason.
- Articles must be spellchecked and proof read for grammatical errors prior to submitting - Do not submit articles filled with spelling errors and bad grammar. We do monitor article submissions and we will reject content that doesn't meet this requirement.
- If you choose to use Images, graphics and video - Be VERY Careful!
An image is any graphic, video footage, photograph, cartoon, drawing, or artwork. By international copyright law, it belongs to the artist who created the artwork. Only they can give permission to reprint the work, and by law, it can only be used with permission.
Yet, many think that if it is on the web, it can be used, freely and whenever and wherever anyone wants. Not true. With flickr, however, there is a loophole. You can use the image, with credit, as long as the link is to the image on flickr and not copied onto your site, and only with images that have such permissions.
Editorial cartoons and photographs, especially nature images, are among the more popular images reposted across the web without permission. These can be hard to track down and prosecute, but it has been done.
If you choose to use an image with your article, get permission first. Look through their website or blog for their copyright policy and reprint permission policy. It is usually found on a specific copyright or policies page, or in the About or Contact Pages. A simple email or posting through a comment on their website or blog will usually get you a response fairly quickly. Many will say yes, many will say no, and some will ask for compensation. All will ask for a link back to their site or blog. To find out if your images have been stolen and used without permission, search Google Images to see if your image is listed and who is linking to it. Also check your server report to find out if someone is hotlinking, linking to an image on your site using your bandwidth.
- For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting graphics/videos you hereby grant Avenstar's Article Vine a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Avenstar's Article Vine You also hereby grant each user of the Avenstar's Article Vine Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service. The above licenses granted by you in User Videos terminate within a commercially reasonable time after you remove or delete your User Videos from the Avenstar's Article Vine. You understand and agree, however, that Avenstar's Article Vine may retain, but not display, distribute, or perform, server copies of User Submissions that have been removed or deleted. The above licenses granted by you in User Comments are perpetual and irrevocable.
- In connection with User Submissions, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Avenstar's Article Vine all of the license rights granted herein.
- Indemnity. You agree to defend, indemnify and hold harmless Avenstar's Article Vine, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Avenstar's Article Vine Website; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Avenstar's Article Vine Website.
- General. You agree that: (i) the Avenstar Article Vine Website shall be deemed solely based in California; and (ii) the Avenstar's Article Vine Website shall be deemed a passive website that does not give rise to personal jurisdiction over Avenstar's Article Vine, either specific or general, in jurisdictions other than California. These Terms of Service shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. Any claim or dispute between you and Avenstar's Article Vine that arises in whole or in part from the Avenstar's Article Vine Website shall be decided exclusively by a court of competent jurisdiction located in Ventura County, California. These Terms of Service, together with the Privacy Notice of Avenstar's Article Vine and any other legal notices published by the Avenstar's Article Vine website, shall constitute the entire agreement between you and Avenstar's Article Vine concerning the Avenstar's Article Vine Website. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Avenstar's Article Vine’s failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Avenstar's Article Vine reserves the right to amend these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the Avenstar's Article Vine Website following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND YOUTUBE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE YOUTUBE WEBSITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
